These terms cover the rules for working with Visual Tonic – that includes web design builds, eCommerce development, WordPress maintenance plans, and any other services provided through visualtonic.com.au. By engaging our services or making a purchase, you’re agreeing to these terms. If you don’t agree, that’s okay – but please don’t engage the services.

Use of the service

Visual Tonic provides web design and development services on a project basis, along with ongoing WordPress maintenance plans. Services are scoped and agreed upfront – what’s in the quote is what’s covered. Anything outside that scope may require a separate quote.

Accounts

If you create an account on visualtonic.com.au – for example to manage a maintenance plan – you’re responsible for keeping your login details secure and for everything that happens under your account. Don’t share your credentials or let anyone else use your account. If we suspect an account is being misused or is in breach of these terms, we may suspend or terminate it.

Payments

Project fees are invoiced as agreed in the project proposal. Standard payment terms are 50% deposit upfront, 50% on completion before final files and logins are handed over. Maintenance plans are billed monthly or annually as selected.

All prices are listed in Australian dollars and are exclusive of GST unless otherwise stated. You’re responsible for any taxes, duties, or fees that apply to your purchase.

Payments are processed securely through our payment providers. We do not store or process card details on our servers – that’s handled entirely by the payment provider.

Projects and Deliverables

Once a project proposal is accepted and a deposit is paid, work is scheduled and begins according to the agreed timeline. Deliverables are as specified in the project proposal.

Two rounds of revisions are included in every project unless otherwise agreed. Significant scope changes after work has commenced may require a revised quote.

Final files, logins, and handover documentation are provided on receipt of final payment.

Refund Policy

Deposits are non-refundable once work has commenced. If a project is cancelled after the deposit is paid but before work begins, the deposit may be retained to cover scheduling and preparation time.

If something is genuinely not delivered as described, contact us within 7 days and we’ll work to resolve it. Any refund or resolution is at our discretion and, if approved, will be returned to the original payment method.

Maintenance plans

Maintenance plans are provided on a monthly or annual basis. You may cancel with one month’s notice. Annual plans paid upfront are non-refundable but the plan will remain active for the full paid period.

Visual Tonic will perform maintenance tasks as described in the selected plan. We take reasonable care with all updates and backups, but cannot guarantee that no issues will ever arise. If something goes wrong as a direct result of our maintenance work, we’ll fix it.

Acceptable use

Don’t misuse the site or our services. That means no unauthorised access, no interfering with how things work, and no using our services in ways that break laws or violate anyone else’s rights. Pretty standard stuff.

Intellectual property

On full payment, you own the design and content of your website. Visual Tonic retains the right to display completed work in our portfolio unless you request otherwise in writing.

Third-party tools used in the build – such as Elementor Pro, WordPress plugins, or fonts – are subject to their own licensing terms. Plugin licences included in a project build are provided for that project only and are not transferable.

Good Templates components and GT Animations Pro are subject to their own separate licensing terms available at goodtemplates.com.

Liability and disclaimers

To the extent permitted by Australian law, Visual Tonic provides services without warranties of any kind. We are not liable for indirect or consequential losses, including loss of data, revenue, or business, arising from the use or inability to use our services.

We’re not responsible for issues caused by third-party plugins, hosting providers, or client-side modifications made after handover.

Termination

We may suspend or terminate a project or maintenance plan if these terms are breached, or if payment is not received within agreed timeframes. If a project is terminated, any work completed to that point may be invoiced.

Changes to these terms

We may update these terms from time to time. Changes will be posted on this page with an updated date. Continued use of our services after changes are published means you accept the updated terms.

Governing law

These terms are governed by the laws of Victoria, Australia. Any disputes will be resolved under Australian jurisdiction.
